Terms of Use
These Terms of Use (“Terms”) govern your access to and use of Brunu, a product of Etra Global AI. (“Company,” “we,” “us,” or “our”), available at brunu.ai and any associated applications or services (collectively, the “Service”). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.
We may update these Terms from time to time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes via email or a notice within the Service.
2. Eligibility and Age Requirements
You must be at least 13 years of age to create an account or use the Service in any capacity. If you are between 13 and 17 years of age, you may only use the Service with the express consent and active supervision of a parent or legal guardian who agrees to these Terms on your behalf and who accepts responsibility for your use. To use the Service independently without parental supervision, you must be at least 18 years of age.
The Service is not intended for, and may not be used by, children under the age of 13. We do not knowingly collect, use, or retain personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete that information promptly.
By using the Service, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into a binding agreement.
Why these age requirements exist
Brunu is an AI-powered service. We enforce a 13-and-older minimum for several overlapping reasons:
- Apple App Store guidelines. Apple requires apps that handle user-generated content, generative AI output, or unrestricted web content to set and enforce a minimum age appropriate for the content rating of the app. Brunu’s 13+ rating in the App Store reflects this requirement, and our in-app age gate enforces it on every signup.
- Children’s online privacy law. The U.S. Children’s Online Privacy Protection Act (COPPA) places strict limits on the collection of personal information from children under 13. The EU GDPR sets a similar baseline (typically 13–16 depending on member state). The Service is not designed to comply with these child-directed regimes; we therefore prohibit use under 13.
- AI-generated content. Responses generated by third-party large language models can occasionally include topics, language, or framing that is not appropriate for younger children, even when the user’s prompt is benign. The 13+ minimum gives a baseline maturity level appropriate for unsupervised AI interaction.
- Third-party data sharing. The contents of your messages are shared with third-party AI providers (Anthropic, OpenAI, ElevenLabs) so they can generate responses. We require users to be old enough to give informed consent to that data sharing.
3. Beta and Early Access Disclaimer
Brunu is currently in a prototype and early access phase. The Service is provided on an experimental basis. Features may be incomplete, unstable, or subject to change without notice. We make no guarantees regarding uptime, accuracy, data persistence, or feature availability during this period. Your feedback helps shape the product — thank you for being an early user.
4. Account Registration and Security
To access certain features, you must create an account. Authentication is handled through Clerk, our third-party identity provider. You are responsible for:
- Providing accurate and complete registration information
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access at info@etra.global
We reserve the right to suspend or terminate accounts that we believe have been compromised or are being used in violation of these Terms.
5. Permitted Use and Restrictions
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
- Scrape, crawl, or systematically extract data from the Service without our written permission
- Use automated tools, bots, or scripts to interact with the Service in ways not intended for human users
- Use the Service for any illegal, fraudulent, or harmful purpose
- Transmit viruses, malware, or any other malicious or harmful code
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Use the Service to harass, abuse, or harm another person
- Impersonate any person or entity, or falsely state your affiliation with any person or entity
- Sell, resell, or sublicense access to the Service without our express written consent
- Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks
5.1. Reporting Objectionable Content and Moderation
The Service contains user-generated content (forecast comments, replies, votes) and AI-generated content (chat replies, generated forecasts, AI-authored analysis). We do not tolerate objectionable content, abusive behavior, or content that violates these Terms or applicable law. Examples include but are not limited to: harassment, hate speech, sexual content involving minors, threats of violence, self-harm encouragement, doxxing, spam, or fraud.
How to report: Every comment in the forecasts feed has a flag/report icon. Every AI chat reply has a report icon in the message action bar. You can also email info@etra.global with the subject line “Content Report” and a link or description of the content.
Our response time: We review every report and act on objectionable content within 24 hours of receiving the report. Action may include removing the content, suspending the user’s account, blocking further submissions, and — in severe cases — referring the matter to law enforcement.
Blocking other users: If another user’s content is bothering you, tap their name on any comment and choose “Block”. You will not see any further content from a blocked user, and they will not be notified of the block. Blocks persist across sessions and devices and can be reviewed in Settings.
We reserve the right to remove content and suspend accounts without prior notice when we judge that the content or behavior violates these Terms or poses a risk to other users or to the Service.
6. AI-Generated Content and Financial Disclaimer
Brunu is not a financial advisor. The Service uses artificial intelligence to generate forecasts, analysis, market commentary, and other content. This content is provided for informational and educational purposes only. It does not constitute financial, investment, trading, legal, or professional advice of any kind.
AI-generated outputs may be inaccurate, incomplete, outdated, or misleading. Past patterns identified by the Service do not guarantee future results. All trading, investment, and financial decisions are solely your own responsibility. You should consult a qualified financial advisor before making any investment decisions.
Etra Global AI. expressly disclaims any liability for losses, damages, or decisions made in reliance on AI-generated content from the Service.
7. User Content and Data
You retain ownership of any content you submit to the Service, including chat messages, uploaded documents, and watchlist configurations (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely to provide and improve the Service.
You represent and warrant that your User Content does not violate any applicable law or the rights of any third party. We are not responsible for User Content submitted by you or other users.
8. Intellectual Property
The Service, including its design, code, features, branding, and AI models, is owned by Etra Global AI. and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property, except the limited license to use the Service as expressly set forth herein.
“Brunu,” “Etra Global AI,” and associated logos are trademarks or service marks of Etra Global AI. You may not use our trademarks without our prior written consent.
9. Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HUMAN STABILITY AI INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GIVEN THAT BRUNU IS IN A PROTOTYPE PHASE, WE MAKE NO REPRESENTATIONS ABOUT THE COMPLETENESS, RELIABILITY, OR ACCURACY OF ANY CONTENT OR FEATURE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUMAN STABILITY AI INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service, including AI-generated forecasts or analysis
- Unauthorized access, use, or alteration of your transmissions or content
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) CAD $100.
12. Indemnification
You agree to indemnify, defend, and hold harmless Etra Global AI. and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of a third party.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, non-payment of applicable fees, or conduct we deem harmful to other users or to the Service.
You may terminate your account at any time by contacting us or using the account deletion feature in Settings. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for the resolution of any disputes arising out of or relating to these Terms or the Service.
15. Miscellaneous
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Etra Global AI. regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
